1. Acceptance of Terms

By accessing or using MIA Optimize ("the Service") provided by MIA Global Studios ("we", "us", "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

MIA Optimize is a web-based SaaS platform that provides website auditing, SEO analysis, GEO (Generative Engine Optimisation) analysis, competitor monitoring, brand DNA extraction, and social content generation services for businesses.

3. Account Registration

To access the Service, you must register using a valid Google account and verify your phone number via SMS. You are responsible for maintaining the security of your account. You must be at least 18 years of age or the age of majority in your jurisdiction to use this Service.

4. Subscription Plans and Payments

The Service offers the following paid plans (in Kenya Shillings):

Payments are processed via Flutterwave or Paystack. By subscribing, you authorise us to charge your chosen payment method. Annual subscriptions include 2 months free. Subscriptions auto-renew unless cancelled before the renewal date.

5. Refund Policy

We offer a 7-day refund policy for first-time subscribers who have used fewer than 5 audits. After 7 days or after your 5th audit, all sales are final. To request a refund, contact support@miaglobalstudios.com.

6. Acceptable Use

You agree not to: (a) use the Service to analyse websites you do not own or have permission to audit; (b) attempt to reverse-engineer or scrape the platform; (c) resell access to the Service without an Agency plan; (d) use automated tools to abuse the Service beyond your plan limits.

7. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. We store your analysis results, brand data, and generated content to power the Service. We do not sell your data to third parties.

8. Intellectual Property

The MIA Optimize platform, its code, design, and methodology are the intellectual property of MIA Global Studios. Content generated by the Service using your website data belongs to you.

9. Service Availability

We aim for 99% uptime but do not guarantee uninterrupted service. We are not liable for downtime caused by shared hosting limitations, third-party API failures, or scheduled maintenance.

10. Limitation of Liability

MIA Global Studios shall not be liable for any indirect, incidental, or consequential damages arising from use of the Service. Our total liability shall not exceed the amount you paid in the 3 months preceding the claim.

11. Termination

We may suspend or terminate accounts that violate these terms, engage in fraudulent activity, or abuse the Service. Upon termination, your data will be deleted within 30 days.

12. Governing Law

These Terms shall be governed by the laws of Kenya. Any disputes shall be resolved in the courts of Nairobi, Kenya.

13. Changes to Terms

We may update these Terms at any time. We will notify registered users via email at least 7 days before material changes take effect. Continued use of the Service after changes constitutes acceptance.
